1. General Terms
This agreement contains the terms and conditions that apply to your purchase from Ecological Waste on products and services provided to you the customer. By accepting delivery of products and/or services, the Customer agrees to be bound by and accept these conditions. No variation to these terms and conditions shall form part of any contract unless specifically accepted by Ecological Waste in writing. These terms and conditions are subject to change at any time, at Ecological Waste sole discretion.
2. Billing and Payment Terms
A).The price of the service provided shall be the Company’s price ruling at the date of the customer’s application process.
B). Ecological Waste reserves the right to alter the Price in the event of government levies, VAT increases, increase of fuel costs or other unexpected increase in operational costs. The Company will provide written notification to the Customer in advance of any change to domestic service
charges.
C). Ecological Waste may for operational reasons change its billing method and frequency after prior notification to the Customer. We reserve the right to issue bills in a paperless format and we may impose an administration charge for the issue of a paper bill. This charge will not exceed €8.50 on an annual basis
D). Customers acknowledge and accept that Ecological Waste Management provides a prepaid service and to ensure collection must have sufficient credit on their account 24 hours prior to their scheduled collection. The Company may, without notice, suspend the service to the customer wholly or partially if the service cost is outstanding for 14 days after the invoice date. In the event of overdue payments, the customer agrees to pay all collection and other costs incurred by Ecological Waste in the settlement process.
E) If the chosen method of payment is by Direct Debit the Customer must ensure that the Bank Account details provided are from a current account which can accept Direct Debits. In the event of a cancellation of a direct debit instruction the Customer shall duly notify the Bank and the Originator Ecological Waste in writing of such cancellation. As a member of the Direct Debit Scheme, in which Banks and Originators of Direct Debits participate, if it is established that an unauthorised Direct Debit was charged to a customer account, the Customer is guaranteed a prompt refund by their Bank of the amount so charged. It is the responsibility of the Customer to advise the Company in writing of any change to Bank account details provided on the original direct debit instruction. Ecological Waste reserves the right to impose an administration charge of up to €10.00 on any/each unpaid direct debit installment. The Customer will be notified in writing of the unpaid amount including administration charge. An alternative payment is required by Ecological Waste for the full sum owed within seven working days from date of unpaid direct debit notification.
F). The Customer may change from one charging option to another with effect from the beginning of any charging period by telephoning the company on 042 9370152 or by delivering written notice – postal or email. It is incumbent upon the customer to ensure the company has received this notification.
G). The Company will not accept any liability if the bin(s) is moved to a different location without prior notice to The Company.
F). Ecological Waste provides the following services for payment:
- Direct Debit
- Bill Pay in the Post Office
- Any retailer that displays the Pay Point sign,
- On the website by Credit or Debit card or through the office in Francis St, Dundalk by cheque, cash, Credit or Debit card (Post Office and Pay Point payments can take 2 working days to reach your account)
Please note: Payments made in shops and Post Offices of less than €15.00 will incur a €1.00 administration fee. Your account must be in credit for the full cost of the bins the day before your scheduled collection day to ensure collection of your bins Ecological Waste reserves the right to withdraw any of these services without prior notice to the customer.
3. Service Agreement
A). This Contract is personal to the Customer. The Customer shall not, except with Ecological Waste written consent or in accordance with the Company’s standard transfer procedures, assign or otherwise transfer the Contract in whole or in part. Part or full payment will be deemed as acceptance of terms and conditions as detailed herein
B).This agreement may be terminated by either party giving to the other at least 30 days written notice.
C).Ecological Waste may modify or suspend the service wholly or partially, with or without notice, if such action is deemed necessary by the Company (e.g. Health & Safety, Security or other valid reasons) or if the company is requested by an authorised authority.
D). The Company will only service Wheelie Bins that are presented on the kerbside.
E). Bins must be left on kerbside the night before scheduled collection
F).The late presentation of a Wheelie bin will not be serviced until the next scheduled collection date for that given waste type unless a call back charge is agreed.
G). In such case where service is not carried out on the day specified in the collection schedule the Company reserves the right to reschedule the visit to the next reasonable opportunity for such service. Ecological Waste shall not be liable for any loss or damage whatever due to its failure to deliver the Services promptly or at all.
H) The Customer accepts and agrees that the Bins are and shall remain the property of Ecological Waste and may only be serviced by the company. Ecological Waste may, without notice, remove its wheelie bins if presented for collection and/or for the use of another waste company. The Customer authorises Ecological Waste representatives to enter on to the Customer’s premises upon which the Bins are located for inspection of the Bins and or recovering possession of the Bins. If any of the Bins are lost or damaged or destroyed following delivery to the Customer, the Customer shall immediately notify the company. Ecological Waste is entitled to receive full compensation payable for the Bins. The charge of €40 will apply to each bin.
I) .Ecological Waste may impose an Increased Monthly Standing Charge and/or Increased per Lift Charge on PrePay Card accounts where the general waste bin is presented less that once every 4 weeks. The Company will provide written notification to the Customer in advance of any change to domestic service charges. In order to ensure non interruption of service a minimum balance of €17 must be kept on pay by use customer accounts.
J) Please note that, if notified by Ecological Waste that your account is on stop you must make payment at least 2 full working days before next collection to ensure your service resumes.
4. Termination of Service
A). Either party can terminate this contract by giving one month’s notice. Termination of the contract must be in writing; by post or email. The written notification of the Customer’s wish to terminate must contain the Customer’s name, address and account details. The company will only accept notification
regarding change or cancellation of the customer contract from the householder and not from any unauthorised third parties.
B) The termination date of a contract must coincide with the last date of the billing period. If a contract is terminated before the minimum contract term of 12 months, the following cancellation charges will apply; (i) early cancellation fee of €25 (ii) surcharge of €25 per bin for returning and cleaning the bins.
C). If a credit applies to a Customer’s account on termination or cancellation of the Services the Customer will receive a refund for the prepaid period less any Cancellation Fee that may be applied.
D). The company will only issue refunds on receipt of the required written termination notification (See 4(a))and the return of the company’s wheelie bins, empty of all waste. All returned bins must be empty or a lift charge will apply. The refund claim period is valid for 30 days from the return date of the company’s wheelie bins.
E) Where a direct debit instruction is terminated before the final payment is made, the Customer is liable for a minimum charge of €100, or for all reasonable administration and legal costs incurred by the company in recovering your final payment.
F) An account will not be terminated until such time as the Ecological Waste wheelie bins are removed from the Customer’s premises and any monies owed on the account is paid in full.
5. Law
These conditions shall be construed in accordance with and governed by Irish Law.
